End-User License Agreement (EULA)
IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA")
is a legal agreement between you (either an individual or a company) and Code Architects
for this Software Product. By installing, copying, or otherwise using the Software
Product, you agree to be bound by the terms of this EULA. If you do not agree to
the terms of this EULA, do not install, copy, or use this software.
*** USER LICENCE ***
1) Code Architects grants you the right to use a Licensed Copy of the software,
provided that if you have registered it with www.vbmigration.com
or with its authorized suppliers.
2) The sale of and/or distribution of copies of this software is strictly forbidden.
It is a violation of this agreement to loan, rent, lease, borrow, or transfer the
use of registered copies of this product.
3) This copy of VB Migration Partner can be used exclusively to convert the set
of VB6 projects whose list was made available to Code Architects prior to purchasing
the user license. Using this copy of VB Migration Partner on VB6 projects not in
this list is strictly forbidden and Code Architects will use any legal or technical
means to ensure that this restriction be enforced.
4) If you use VB Migration Partner to provide migration services to 3rd party individuals
or companies - that is, if you neither possess the Intellectual Property (IP) of
the application you are converting nor you have the right to sell the application’s
source code - it is essential that the 3rd party individual or company who is the
sole proprietor of the Visual Basic 6 source code being migrated purchase a VB Migration
Partner’s user license that covers the original Visual Basic 6 code, regardless of whether the 3rd party individual
or company resells the application or just uses it internally.
5) Site License Only: The Site License allows use of this product
on an unlimited number of CPUs at a single customer site or location and is otherwise
subject to all other restrictions described in this EULA. Specifically, it cannot
be used for redistribution of the product to 3rd parties and cannot be used to convert
VB6 projects not included in the list made available to Code Architects prior to
purchasing the user license.
6) This Agreement will immediately and automatically terminate without notice if
you fail to comply with any term or condition of this Agreement. You agree upon
termination to promptly destroy the Software Product together with all of its component
parts, prior and replacement versions, and all copies and modifications thereof
in any form.
*** OWNERSHIP AND INTELLECTUAL PROPERTY ***
7) VB Migration Partner is owned by Code Architects and is protected by international
copyright laws and treaty provisions. Therefore, you must treat the software like
any other copyrighted material (e.g., a book or musical recording) except that you
may either (a) make one copy of the Software solely for backup or archival purposes,
or (b) transfer the Software to a single hard disk provided you keep the original
solely for backup or archival purposes.
8) The foregoing license gives you limited rights to use the Software. Although
you own the media on which the Software is recorded, you do not become the owner
of, and Code Architects retains title to the Software and all copies thereof.
9) All ownership, title and intellectual property rights in and to the Software
Product (including but not limited to any images and text incorporated into the
application), are owned by Code Architects.
*** LIMITATION OF RESPONSABILITY ***
10) Whilst every care has been taken in the construction and testing of this software,
it is supplied subject to the condition that the user undertakes to evaluate the
suitability of the control for his/her purposes. Code Architects makes no representation
of the software's suitability for any purpose.
11) To the maximum extent permitted by applicable law, Code Architects provides
the Software Product and any support services (including instructions for its use)
AS-IS AND WITH ALL FAULTS, and hereby disclaims all warranties and conditions, either
express, implied or statutory, including, but not limited to, any (if any) implied
warranties or conditions of merchantability, of fitness for a particular purpose,
of lack of viruses, of accuracy or completeness of responses, of results, and of
lack of negligence or lack of workmanlike effort, all with regard to the Software
Product, and the provision of or failure to provide Support Services.
Also, there is no warranty or condition of title, quiet enjoyment, and quiet possession,
correspondence to description or non-infringement, with regard to the software product.
The entire risk as to the quality of or arising out of use or performance of the
software product and support services, if any, remains with you.
12) In no event shall Code Architects be liable for any indirect, incidental, consequential,
special or exemplary damages or lost profits whatsoever (including, without limitation,
damages for loss of business profits, business interruption, loss of business information,
or any other pecuniary loss) arising out of the use or inability to use the software
product, even if code architects has been advised of the possibility of such damages.
13) You agree to defend, indemnify and hold Code Architects and its suppliers harmless
from and against any and all claims, losses, liability costs and expenses (including
but not limited to attorneys' fees) arising from Your use of the Software, including,
without limitation, your violation of these User License, or any third-party's rights,
(including, without limitation, infringement of any copyright, violation of any
proprietary right and invasion of any privacy rights). These obligations will survive
any termination of your use of the Software.
14) Should Code Architects go out of business or should it discontinue the support
for the Software, the source code of VB Migration Partner’s support library
will be made available to customers immediately and free of any additional charges.

15) VB Migration Partner Trial Edition is meant to be for evaluation purposes only.
You don’t have the right to sell or make direct or indirect profit by distributing
any VB.NET application that is generated by VB Migration Partner Trial Edition,
either in source code or in compiled format.
